Conditions of access to the site

The present document is an agreement between the EUF (“the Publisher” or “We”) and you, a person (hereinafter “the User”) who accesses the present website, regarding the use of the EUF website (www.uni-foundation.eu and its affiliate websites, jointly “the Websites”) and services.

The Websites are accessible at all times anywhere in the world. The User who connects to it bears the sole responsibility for compliance with the legislation and/or regulations in force in the country where they reside or from where they connect to the Websites.

Modification of these conditions of use, jurisdiction and applicable law

We may update these conditions to reflect changes to our practices. If we make any material changes, we will notify Users by means of a notice on our sites prior to the changes becoming effective. We encourage you nonetheless to periodically review this page for the latest information on our terms and privacy practices.

Any dispute concerning these terms and condition shall be governed by the laws of Luxembourg. In case any dispute, controversy or claim arising out of or relating to the subject matter hereof cannot be settled amicably between the User and us, it shall be submitted to the exclusive jurisdiction of the courts of Luxembourg.

Although all the information on the Websites is checked thoroughly, it is disseminated for information purposes only. We take the necessary technical and organisational measures to ensure the accuracy of the information, yet we cannot be held responsible for the accuracy of provided information nor guarantee that the details within the websites are always fully complete, accurate and up to date. All information is provided subject to modification, error or omission.

We decline all responsibility for content coming from third parties to which the website has hyperlinks.

Processing of personal data

Your privacy is important to us, and we are fully committed to keeping your personal information safe. This privacy policy is intended to provide you with information about the personal information we collect on this website and how that information is used and shared. We collect personal information about you when you access this website or when you use any of our products, applications or services (collectively our “Services”).

This document outlines our approach to compliance with the General Data Protection Regulation (GDPR) and all other relevant data-protection legislation. It also sets forth your privacy rights. Please take a moment to familiarise yourself with our privacy practices.

It is important that you read this privacy policy together with any other privacy policy we may provide on specific occasions so that you are fully aware of how and why we are using your data. This privacy policy supplements the other notices and is not intended to override them.

In some cases, especially when the user completes and returns a form on the website, it is possible that some personal data may be saved on our server or storage solution provided by Google, Microsoft or other service providers. This information is considered confidential and treated as such. It will never be sold or transmitted to third parties without the user’s approval.

Information we collect and how we use it

We offer a newsletter service. We will only send you these newsletters with your explicit consent. We collect and use your information to send you the newsletter you have requested and in some cases to personalise the email we send. You can opt out at any time by unsubscribing at the bottom of each email newsletter communication. In that case, we will need a valid email address that the User who subscribes to the newsletter accepts to communicate via our specific form. The User confirms in such instance that they are the owner of said email address as communicated and agree to receive emails sent by us. The User has the right to unsubscribe at any time. More information about our newsletter and our relevant privacy practices is provided at the moment of subscription to such newsletter.

We also organise specific events in relation to which registration of Users may be needed through a specific form. In such cases we could collect personal data to: allow Users to participate in the webinars; be able to carry out the obligations inherent to the initiatives and activities organised; involve Users in initiatives and activities organised or promoted by us; fulfil any obligations of managerial, administrative and accounting nature related to the event; fulfil any legal obligations; and fulfil any reporting obligations related to the event.

We also reserve a limited right to access the data in order to proactively analyse the system architecture, data models and infrastructure resources in order to offer the best possible service. This includes, for example, analysis of slow-running database queries, predicting the growth rate of data (in order to allocate resources ahead of time), and analysis of the data contents and format in order to choose the most performant and fitting data models. It is unavoidable that, in order to be able to provide the best possible service, we must be able to understand the data, as well as emergent trends in the data. Such analysis is done, whenever practical, in an anonymised manner and with only the above, purely technical or service-oriented purposes in mind.

The legal basis for processing your information

We collect your information for a number of purposes and rely on a number of different legal bases to use your personal information.

1) We will, in certain circumstances (such as to provide you with our newsletter), rely on your explicit consent to process your personal information. Where we do, you have the right to withdraw your consent at any time. In most circumstances, your consent can be withdrawn by following the unsubscribe instructions included at the end of each email communication from us. 2) In other cases, we may be required to process your personal information to comply with certain legal obligations to which we are subject, including:

  • Providing information to Government bodies or agencies when required to do so by law
  • If you have exercised one of your data rights, we will retain a copy of all correspondence to demonstrate our compliance with data-protection legislation
  • If you have exercised one of your data rights and ask us not to contact you by email at a particular email address, we will need to retain a copy of that email address in order to comply with your no-contact request
  • To carry out our audits

3) We may process your personal information for carefully considered and specific purposes which are in our legitimate interests and enable us to enhance the services we provide, but which we also believe benefit you. Our legitimate interests do not automatically override your interests. You have the right, free of charge, to object to our use of your personal information for our legitimate interests. When and how your information is shared

1) We may share your personal information with third-party service providers which perform services and functions at our direction and on our behalf such as our accountants, IT service providers, printers, payment providers, lawyers, providers of security and administration services and other business advisers.

2) We provide certain services and run promotions in conjunction with third parties and we may share your personal information if the service you have requested is fulfilled by them. We may also share your personal information with third parties that may receive and process your personal information as a data controller in their own right. All these third parties have their own security and privacy policies. You are advised to review these separately.

3) We may share your personal data with a third-party auditing organisation in accordance with our legitimate interests to verify aggregated statistics about circulation and usage of our services or to review our policies, processes and procedures for compliance with relevant standards.

4) If you apply for a job posting on our website, the personal information you provide to us (including sensitive information) may be shared with third-party recruiters or service providers if needed.

5) Our Websites use interfaces with social media sites such as Facebook, LinkedIn, Twitter and others. These features may collect your IP address, the page you are visiting on our Websites and may set a cookie to enable the feature to function properly. If you choose to like or share information from our sites through these services, you should review the privacy policy of that service. These practices are governed by the privacy statements of these social networks and you are advised to review these separately.

6) Our services through the Websites may involve third-party tracking tools from our service providers, examples of which include Google Analytics. Such third parties may use cookies, APIs, and SDKs in our services to enable them to collect and analyse user information on our behalf. These third parties may have access to information such as your device identifier, MAC address, IMEI, locale (specific location where a given language is spoken), geolocation information, and IP address for the purpose of providing their services under their respective privacy policies. Our privacy policy does not cover the use of tracking tools from third parties. We do not have access or control over these third parties. You may refuse the use of cookies by selecting the appropriate settings on your browser, however, please note that if you do this you may not be able to use the full functionality of this website. Data storage and retention

We will retain your personal information as needed to fulfil the purposes for which it was collected. We will retain and use your personal information no longer than is necessary to comply with our business and legal obligations. In general, we make reference to the time limitations related to any potential auditing, to the ongoing provision of services to users, and to the applicable statute of limitation.

International transfers

We may transfer your personal data outside the European Economic Area (EEA). These countries do not always afford an equivalent level of privacy protection and in such circumstances we take specific steps, in accordance with data protection law to protect your personal information. In particular, for transfers of personal data outside the EEA we rely either on an adequacy decision by the European Commission, on contractual protection approved by the European Commission, or on your explicit consent.

Our policy regarding children

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to use services related to our Websites. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under the age of 13 should provide us with any personal information. In the event that we become aware that we have collected personal information from an individual under the age of 13, we will delete that information without delay. Your data subject rights

You have several rights under data-protection law in relation to how we use your personal information. You have the right, free of charge, to:

  • Request a copy of the personal information we hold about you in a structured, commonly used and machine-readable format
  • Rectify any inaccurate personal information we hold about you
  • Withdraw your consent where we have relied upon your consent to process your information
  • Erase the personal information we hold about you subject to certain exceptions
  • If technically feasible, have your personal information transmitted to another data controller in a machine-readable format at your request
  • Restrict processing of your personal information in certain circumstances
  • Object to our use of your personal information for our legitimate interests, for profiling and for direct marketing purposes
  • Not be subject to a decision which is based solely on automated processing where that decision produces a legal effect on you or otherwise significantly affects you. We do not make automated decisions of this nature
  • Lodge a complaint with the appropriate data-protection authority if you have concerns about how we process your personal data

We will take measures to verify your identity which we will do by reference to copies of acceptable identification documentation supplied by you.

We will endeavour to respond to your request within a month. If we are unable to deal with your request within a month we may extend this period by a further two months and we will contact you and explain why.

Consequences of not providing information

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you. For example, the failure to provide contact details for events or newsletter subscriptions will entail our impossibility to register users to such events or in our mailing lists. In general, in each specific instance we will inform Users on the mandatory nature or not of the provision of their personal data.

Security

We take all the necessary technical and organisational measures to protect the confidentiality and security of your information from unauthorised access or against loss, misuse or alteration by third parties. We make good faith efforts to store the information collected in relation to the Websites in a secure operating environment that is not available to the public and is only accessible by authorised employees, agents or contractors and we verify the identities of registered users before they can access personal information stored about them. We store information on servers located in France and Germany, and may store information on servers and equipment in other countries within the European Union. Specific privacy policies

In case of incompatibility between this document and the privacy policies provided for specific processing (newsletter, events, etc…), the latter should prevail.
